The Desk Order Divorce Process in BC
If you meet the eligibility requirements, a desk order divorce typically involves these steps

Filing the
Application
You start by filing a Notice of Family Claim (Form F3) in the Supreme Court of British Columbia.
You must also provide supporting documents, such as a separation agreement (if applicable) and marriage certificate.

Serving the
Documents
Your spouse must be formally served with the divorce documents.
- If they live in Canada: they have 30 days to respond.
- If they live in the USA: they have 60 days.
- If they live elsewhere: they have 90 days.

Waiting
Period
If your spouse does not dispute the claim, you can proceed with the Desk Order Divorce application by filing additional paperwork, including:
- Affidavit – Desk Order Divorce (Form F38)
- Child Support Affidavit (if applicable)

Court Review
Without a Hearing
A BC Supreme Court judge reviews your documents without a court appearance.
If everything is complete and accurate, the judge will issue a Final Divorce Order.
